These terms of use apply to the ArtZone app, an app created by The Santa Barbara Arts Collaborative, Inc (hereinafter referred to as "SBAC," "we," or "us"), which also runs the Funk Zone Map, and other programs. The Funk Zone Map is a printed map of Santa Barbara's Funk Zone, with web listings at funkzone.net. The ArtZone App is a guide to Santa Barbara’s Funk Zone and the surrounding neighborhoods. It features local artists and businesses contributing to the creative and cultural ecology of Santa Barbara—local art, drink, food, clothes, crafts, objects, etc—creative works of all kinds.
By accessing or using the ArtZone app (the "App"), you agree to comply with and be bound by the following terms and conditions of use (the "Terms"). If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By using the ArtZone App, you agree to these Terms, as well as our Privacy Policy. If you do not agree to any of these terms, please do not use the App.
2. User Content
a. Photo Uploads: As a user of the ArtZone App, photos may be uploaded to your profile. You grant SBAC, its directors, officers, employees, licensees, and affiliates a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, publicly display and perform, create derivative works from, and otherwise exploit such photos in connection with the App and SBAC's promotional and marketing activities.
b. User Responsibilities: You are solely responsible for the photos you upload to the App. You represent and warrant that you have all necessary rights, consents, and permissions to upload and grant the rights specified in section 2(a).
3. Intellectual Property
a. Ownership: SBAC retains all rights, title, and interest in and to the App, including all content, features, and functionality. The App is protected by copyright, trademark, and other laws.
b. User License: Subject to these Terms, SBAC grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for both personal and commercial purposes.
4. User Conduct and Policies
a. Prohibited Activities: You may not use our Products to do or share anything that:

Violates these Terms or other terms and policies that apply to your use of our Products.

Is unlawful, misleading, discriminatory, or fraudulent (or assists someone else in using our Products in such a way).

You do not own or have the necessary rights to share.

Infringes or violates someone else's rights, including their intellectual property rights (such as by infringing another’s copyright or trademark, or distributing or selling counterfeit or pirated goods), unless an exception or limitation applies under applicable law.
5. Termination
SBAC reserves the right to terminate or suspend your access to the App at any time, with or without cause, and without notice.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Changes to Terms:
SBAC reserves the right to update or modify these Terms at any time without prior notice. Continued use of the App after such modifications will constitute your acceptance of the revised Terms.
